Please read these terms and conditions (Terms) carefully. By using, browsing and/or reading the Website, this signifies that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website, or any of the Services, immediately.

(c) Jessica Lea Photography reserves the right to review and change any of the Terms by updating this page at its sole discretion. When Jessica Lea Photography updates the Terms, it will use reasonable endeavours to provide you with notice of updates to the Terms. (iii) print pages from the Website for your own personal and non-commercial use.

(ii) Jessica Lea Photography will not be liable for any special, indirect or consequential loss or damage (unless such loss or damage is reasonably foreseeable resulting from our failure to meet an applicable Consumer Guarantee), loss of profit or opportunity, or damage to goodwill arising out of or in connection with the content or these Terms (including as a result of not being able to use the content or the late supply of the content), whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise.

(c) Use of the Website and the content is at your own risk. Everything on the Website and thecontent is provided to you "as is" and "as available" without warranty or condition of anykind. (b) You expressly understand and agree that Jessica Lea Photography, its affiliates, employees, agents, contributors and licensors shall not be liable to you for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability. This shall include, but is not limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation and any other intangible loss.

(c) You acknowledge and agree that Jessica Lea Photography holds no liability for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you as a result of providing your content to the Website.

(d) Nothing in these Terms restricts, excludes, or modifies any consumer guarantees, rights or remedies you may have under the Australian Consumer Law. To the extent permitted bylaw, our liability for any breach of a consumer guarantee is limited to the resupply of services or payment of the costs of having the services resupplied.

7. Termination of Contract

(a) If you want to terminate the Terms, you may do so by providing Jessica Lea Photography with days' notice of your intention to terminate by sending notice of your intention to terminate to Jessica Lea Photography via the 'Contact Us' link on our homepage.

(b) Jessica Lea Photography may at any time, terminate the Terms with you if:

(i) you have breached any provision of the Terms or intend to breach any provision;

(ii) Jessica Lea Photography is required to do so by law;

(iii) Jessica Lea Photography is transitioning to no longer providing the Services to Members in the country in which you are resident or from which you use the service; or

(iv) the provision of the Services to you by Jessica Lea Photography, is in the opinion of Jessica Lea Photography, no longer commercially viable.

(d) Subject to local applicable laws, Jessica Lea Photography reserves the right to discontinue or cancel your access at any time and may suspend or deny, in its sole discretion, your access to all or any portion of the Website or the Services without notice if you breach any provision of the Terms or any applicable law or if your conduct impacts Jessica Lea Photography's name or reputation or violates the rights of those of another party.

(e) Prior to any suspension or termination under these Terms, Jessica Lea Photography shall provide you with 7 days written notice detailing the alleged breach and a reasonable opportunity to remedy the situation, except in cases of serious or willful misconduct, illegal activity, or immediate security risks. Any dispute regarding termination may be resolved through the dispute resolution process outlined in these Terms.

(f) When the Terms come to an end, all of the legal rights, obligations and liabilities that you and Jessica Lea Photography have benefited from, been subject to (or which have accrued over time whilst the Terms have been in force) or which are expressed to continue indefinitely, shall be unaffected by this cessation, and the provisions of this clause shall continue to apply to such rights, obligations and liabilities indefinitely.

8. Indemnity

(a) You agree to indemnify Jessica Lea Photography, its affiliates, employees, agents, contributors, third party content providers and licensors from and against:

(i) all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with your content;

(ii) any direct or indirect consequences of you accessing, using or transacting on the Website or attempts to do so; and/or

(iii) any breach of the Terms.

9. Dispute Resolution

9.1 Compulsory:

If a dispute arises out of or relates to the Terms, either party may not commence any Tribunal or Court proceedings in relation to the dispute, unless the following clauses have been complied with (except where urgent interlocutory relief is sought).

9.2 Notice:

A party to the Terms claiming a dispute (Dispute) has arisen under the Terms, must give written notice to the other party detailing the nature of the dispute, the desired outcome and the action required to settle the Dispute.

9.3 Resolution:

On receipt of that notice (Notice) by that other party, the parties to the Terms (Parties)must:

(a) Within 28 days of the Notice endeavour in good faith to resolve the Dispute expeditiously by negotiation or such other means upon which they may mutually agree;

(b) If for any reason whatsoever, 28 days after the date of the Notice, the Dispute has not been resolved, the Parties must either agree upon selection of a mediator or request that an appropriate mediator be appointed by the Conflict Resolution Service (CRS);

(c) The Parties are equally liable for the fees and reasonable expenses of a mediator and the cost of the venue of the mediation and without limiting the foregoing undertake to pay any amounts requested by the mediator as a precondition to the mediation commencing. The Parties must each pay their own costs associated with the mediation;

(d) The mediation will be held in Brisbane, Queensland, Australia.

9.4 Confidential

All communications concerning negotiations made by the Parties arising out of and in connection with this dispute resolution clause are confidential and to the extent possible, must be treated as "without prejudice" negotiations for the purpose of applicable laws of evidence.

9.5 Termination of Mediation:

If 2 months have elapsed after the start of a mediation of the Dispute and the Dispute has not been resolved, either Party may ask the mediator to terminate the mediation and the mediator must do so.

9.6 Post-Mediation Procedures:

If mediation is terminated without resolution, the Parties must within 14 days participate in a conciliation conference with a mutually agreed independent senior counsel to provide a non-binding evaluation of the Dispute before commencing any legal proceedings. The costs of the conciliation conference shall be shared equally between the Parties.

10. Venue and Jurisdiction

The Services offered by Jessica Lea Photography is intended to be viewed by residents of Australia. In the event of any dispute arising out of or in relation to the Website, you agree that the exclusive venue for resolving any dispute shall be in the courts of Queensland, Australia.

11. Governing Law

The Terms are governed by the laws of Queensland, Australia. Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relating to the Terms and the rights created hereby shall be governed, interpreted and construed by, under and pursuant to the laws of Queensland, Australia, without reference to conflict of law principles, notwithstanding mandatory rules. The validity of this governing law clause is not contested. The Terms shall be binding to the benefit of the parties hereto and their successors and assigns.

12. Severance

If any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, that part shall be severed and the rest of the Terms shall remain in force.

13. Data Protection and Security

We implement industry-standard security measures to protect your personal information. Your data will only be collected with explicit consent, stored securely for the duration necessary, and processed in accordance with Australian Privacy Principles. You may request access to, correction, or deletion of your personal information at any time by contacting Jessica Lea Photography.



CANCELLATION POLICIES

Cancellation Policies for Portait, Family, Newborn, Lifestyle & Professional Headshot Sessions are provided prior to payment for any booking. Booking times are requested through the site and then all documents including our terms of service, cancellation and rescheduling policy are provided to you via email, prior to payment for the session.

Wedding and Commercial Contracts are bound by a different cancellation policy, details of which are detailed in those particular contracts. SHIPPING POLICY

Thank you for visiting and shopping at Jessica Lea Photography. The following information sets out the terms and conditions that constitute our Shipping Policy.

1. Processing your Order

An email confirmation is sent to your e-mail address after placing your order. Please keep this email as proof of your purchase.

2. Shipment Processing Time

Processing time refers to the time it takes for us to prepare your order for shipping.

After your payment is authorised and verified, all orders are processed within 3 business days. We will contact you if, for some reason, there are any delays.

2.1 Print Processing Times:

Print processing times may vary with each supplier. We only use the best photographic print suppliers in Australia. The print processing times vary between 3 business days for most canvas and paper prints and 10 business days for glass and aluminium prints as a guide.

3. Shipment Locations

3.1. Domestic and International

Jessica Lea Photography ships domestically as well as internationally. If you have a question about domestic or international deliveries, please contact us at info@jessicaleaphotography.com.au.

3.2 Shipping Restrictions

Our company does ship to both commercial and domestic addresses.

4. Shipment rates and delivery estimates

We endeavour to get your order to you as soon as possible. Once your order is placed, an estimated delivery time will be provided to you. Delivery times are estimates and commence from the date of shipment, rather than the date of order. Delivery times are to be used as a guide only and are subject to the acceptance and approval of your order. Estimated arrival dates are not guaranteed. Weather delays and other unforeseen circumstances may impact delivery time. Unless there are exceptional circumstances, we make every effort to fulfil your order.

(a) Express Shipping (within Australia)

The order will arrive within 2 - 3 business days after the printing process has been completed. This will vary for countries outside of Australia.

Express Shipping costs will be calculated individually for each order and are therefore TBD.

(b) Standard Shipping (within Australia)

The order will arrive within 3 - 7 business days after the printing process has been completed.

Standard Shipping costs for domestic prints are included in the print price. Therefore there is free domestic shipping available within Australia.

Please note:

(a) Business day means Monday to Friday, except holidays.

(b) Orders are not shipped or delivered on weekends or holidays.

(c) Date of delivery may vary due to carrier shipping practices, delivery location, method of delivery, and the items ordered.

(d) Products may be delivered in separate shipments.

(e) When placing your order, we consider these factors when calculating the Estimated Delivery Date:

(i) Transit Time: The amount of time it takes your order to leave our distribution centre and arrive at the local delivery carrier.

(ii) Weight factor: Shipping costs are based on the weight of your order and the delivery method. To find out how much your order will cost, simple add the items you would like to purchase to your cart, and proceed to the checkout page. Once at the checkout screen, shipping charges will be displayed.

(f) Due to unforeseen circumstances such as print delays, packages to and from our facility in may be delayed. We appreciate your patience during this time.

(g) We will not be responsible for wrong shipping address if you provide incorrect information.

(h) In-store pickup dates vary based on product availability.

5. Tracking Options

Jessica Lea Photography aims to provide visibility and transparency throughout the shipment process. Once your order is confirmed and shipped, you will receive a link to track your package.

5.1 Domestic and International

All orders delivered within Australia automatically have tracking.

International orders are sent with various courier and postal services. Most of these services comes with tracking and your tracking number will be sent to you once it has been posted. If we are requested to make alternative shipping arrangements we cannot guarantee tracking and will not be responsible for the delivery of orders sent internationally.

6. International Customs, Duties and Taxes

All orders shipping to a destination outside of Australia are subject to the import duties, fees, and taxes of the destination country. Delays in delivery may occur if your package is randomly selected by your country’s Customs Department. Jessica Lea Photography is not responsible for any possible customs and taxes applied to your order. We have no control over the process or additional charges associated with the delivery and importation of your order (package) into your country. We do not benefit in anyway from these chargers and we work very closely with our brokers and carriers to ensure as few delays as possible. All fees imposed during or after shipping are the responsibility of the customer. You agree that you are responsible for any duty, taxes, and custom requirements or other like taxes, fees, levies, costs or expenses associated with importing products you purchase from us and shipping them internationally.

Damages

If there is any damage to the packaging on delivery, contact us immediately at info@jessicaleaphotography.com.au.

Missing or Lost Package

There are several reasons why a package gets lost or becomes a deliver exception. We’ve found that, more often that not, the package is either in the building or with a neighbour. Jessica Lea Photography politely requests that customers look in common courier hiding spots. Please take a look around and let us know if you find it. If you haven't located your order, please contact us at info@jessicaleaphotography.com.au to report missing or lost packages.

REFUND POLICY - PRINT & DIGITAL SERVICES

This Refund Policy ("Policy") applies to the following purchases: Prints - all mediums, any and all digital files, all online services including but not limited to courses, print installations and any purchases made through www.jessicaleaphotography.com.au. Refunds or cancellations of booked services is handled within the Terms of Service and Cancellation Policy.

General

(a) We offer refunds, repairs and replacements in accordance with the Australian Consumer Law and on the terms set out in this Policy.

(b) Any benefits set out in this Policy may apply in addition to consumer's rights under the Australian Consumer Law.

(c) Before making a purchase, please read this Policy so that you can understand your rights and what you can expect from us if you are not satisfied with your order.

Australian Consumer Law

(a) Under the Australian Consumer Law:

(i) Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the goods, you are entitled

(1) to cancel the purchase; and

(2) to a refund for the price of the goods; and

(3) compensation for any damage or loss (whether direct or consequential) that was, or reasonably ought to have been, foreseeable by us.

(ii) If the failure with the service does not amount to a major failure, you are entitled toto a re-supply of the goods within a reasonably time, or to cancel the purchase andbe provided with a refund of any price paid.

(b) We offer refunds, repairs, and replacements in accordance with the Australian Consumer Law.

(c) The Australian Consumer Law provides a set of Consumer Guarantees which protect consumers when they buy products and services.

(d) If the Australian Consumer Law applies, then we cannot avoid the Consumer Guarantees which it provides. If there is an inconsistency between this Policy and the Australian Consumer Law, the Australian Consumer Law will prevail.

(e) Further information about the Australian Consumer Law and these Consumer Guarantees is available from the website of the Australian Competition and Consumer Commission.

(f) If a product or service which you purchased from us has a major failure (as defined in the Australian Consumer Law) then you may be entitled to a replacement or refund. You may also be entitled to compensation for any reasonably foreseeable loss or damage resulting from that major failure.

(g) If a product or service which you purchased from us has a failure which does not amount to a major failure (as defined in the Australian Consumer Law) then you may still be entitled to have the goods repaired or replaced.

Cancellation and Change of Mind

We do not offer any refund if you change your mind, or find the same product or service cheaper elsewhere.

Products Damaged During Delivery

(a) In the event that the product you ordered has been damaged during delivery:

(i) Please contact us as soon as possible.

(ii) Any damaged product must be returned in the condition in which it was received, together with any packaging and other items which you received with the damaged product.

(b) We will arrange to repair or collect the damaged product and replace it with an equivalent product, or to refund it, provided that you have contacted us within 7 days from the date of receiving the product.

Exceptions

Notwithstanding the other provisions of this Policy, we may refuse to provide a repair, replacement or refund for a product or service purchased by you if:

(a)You misused the said product in a way which caused the problem.

(b) You knew or were made aware of the problem(s) with the product or service before you purchased it.

(c) You asked for a service to be done in a certain manner, or you asked for alterations to a product, against our advice, or you were unclear about what you wanted.

(d) Any other exceptions that apply under the Australian Consumer Law.

Shipping Costs for Returns

(a) In the event that a product you have purchased fails to meet one or more Consumer Guarantees under the Australian Consumer Law, we shall bear any cost of shipping the said product (the "Returned Product") back to us, as well as any cost of shipping any replacement product to you.

(b) If the Returned Product can easily be shipped or returned, then you are responsible for organising for the Returned Product to be returned to us. If the Returned Product is eligible for a repair, replacement or refund under the terms of this Policy (including under the Australian Consumer Law) then we will reimburse you for the reasonable postage, shipping or transportation costs for the Returned Product.

(c) If the Returned Product is too large, too heavy, or otherwise too difficult to be removed and returned by you, and is believed to be eligible for a repair, replacement or refund under the terms of this Policy (including under the Australian Consumer Law), then we will organise for the postage, shipping, transportation or collection of the Returned Product, at our cost.

(d) In the event that we organise and pay for the inspection, postage, shipping, transportation or collection of a Returned Product, and it turns out not to be eligible for a repair, replacement or refund under the terms of this Policy (including under the Australian Consumer Law), then you will be required to pay the costs of any inspection, postage, shipping, transportation or collection of the Returned Product.

(a) We aim to process any requests for repairs, replacements or refunds within 3 days of receipt.

Overseas transfer

Your Personal Information may be transferred overseas or stored overseas for a variety o freasons such as using an overseas postal or courier contractor for the delivery of your products.Your information is not provided to overseas providers for any marketing or advertising purposes.It is not possible to identify each and every country to which your Personal Information may besent, however, the main countries used are located within the United States, United Kingdom,Canada and New Zealand. If your Personal Information is sent to a recipient in a country withdata protection laws which are at least substantially similar to the Australian Privacy Principles, and where there are mechanisms available to you to enforce protection of your Personal Information under that overseas law, we will not be liable for a breach of the Australian Privacy Principles if your Personal Information is mishandled in that jurisdiction.
